This Personal Data Protection Notice (“Notice”) is issued pursuant to the Malaysian Personal Data Protection Act 2010 (“PDPA”).

This website, https://khayatreebangsar.com/ (“Website”), is operated for marketing and information purposes on behalf of the developer, Melati Ehsan Holdings Berhad and its subsidiaries (hereinafter collectively referred to as “Melati Ehsan Group”).

In the course of your dealings with us through this Website, you may be requested to provide personal data and information (“Personal Data”) to enable us to facilitate enquiries, provide information, arrange viewings, process registrations, and assist with transactions relating to the developer’s projects. Such Personal Data is essential for business operations, execution and delivery of services, client relationship management, planning of future product launches, promotional activities, and other related events organized by the Melati Ehsan Group.

The types of Personal Data collected may include, but are not limited to:

  • Employer details

  • Race, ethnic origin, nationality

  • Loan application details

3. Consequences of Failure to Provide Personal Data

Failure to provide the required Personal Data may result in:

  • Our inability to provide the requested information, notices, services, and/or products;

  • Difficulty or delay in facilitating the execution and completion of Sales and Purchase Agreements or related documentation; and/or

  • Our inability to update you on the latest products, launches, promotions, and services offered by the developer.

4. Purpose of Collecting Personal Data

Your Personal Data may be collected, used, and otherwise processed for purposes including, but not limited to:

  • Responding to enquiries and arranging property viewings;

  • Sending invitations to property launches, promotional materials, advertisements, and administrative notices;

  • Recommending properties similar to those previously enquired or purchased (if applicable);

  • Delivery and marketing of notices, services, and/or products;

  • Facilitating execution of agreements and/or contracts relating to properties and services;

  • Customer relationship management;

  • Conducting marketing activities and customer profiling;

  • Performing credit assessments and background checks (where applicable);

  • Maintaining internal records;

  • Collection of outstanding payments (if applicable);

  • Preventing fraud, money laundering, bribery, and other criminal activities;

  • Complying with legal and regulatory obligations;

  • Conducting research, benchmarking, and statistical analysis;

  • Sending communications about products and services offered by selected third parties (subject to consent);

  • Managing vacant possession, key handovers, property or estate management matters, customer care, and defect rectification; and

  • Contractors, subcontractors, and third-party service providers engaged by the developer;

  • Property management companies managing the purchased properties;

  • Loyalty programme service providers;

  • Utilities and service providers, including but not limited to:

    • Tenaga Nasional Berhad

    • Syarikat Bekalan Air Selangor Sdn Bhd

    • Indah Water Konsortium

  • Actual or prospective purchasers in the event of a sale, merger, or acquisition; and

  • Other relevant entities such as Joint Management Bodies, Management Corporations, banks, financial institutions, and appointed valuers.

6. Safeguards

Reasonable administrative, technical, and physical security measures will be implemented to protect your Personal Data against unauthorized access, loss, misuse, alteration, or disclosure, in compliance with applicable laws and regulations.

7. Data Transfer and Sharing

Where necessary for data storage, processing, or service provision, your Personal Data may be transferred to affiliated companies or third-party service providers within or outside Malaysia. Such transfers will be subject to appropriate safeguards to ensure confidentiality and comparable levels of data protection.
